The triple talaq has always been in controversy since the previous Modi government tabled it in Lok Sabha in 2017. Prime minister Narendra Modi made a strong pitch but due to the opposition, the bill was stalled.
Triple talaq bill makes the declaration of talaq-e-biddat in spoken, writing, or SMS or through any other electronic chat illegal. It also gives power to the police to arrest the offender without any warrant. The Muslim man pronouncing triple talaq also attracts the jail term of 3 years which is bailable but only when the magistrate has listened to the aggrieved women.
A woman divorced through talaq-e biddat has the right to demand maintenance for her and her dependent child under the triple talaq bill. The magistrate has the right to decide the amount of
subsistence allowance. Also, the woman is entitled to seek custody of the child. This is further decided by the magistrate.
